禮物卡條款
條款及細則 - 咖啡禮物卡及「請朋友」咖啡劵
通過使用此服務,代表客戶同意本協議的條款。
咖啡禮物卡(實體版及電子版)及「請朋友」咖啡劵,適用於所有eCup合作咖啡店上供應之飲品及小食,透過eCup App下單使用。 顧客需自行前往Cafe領取飲品及食品。
所有字眼關於 「eCup」,均代表 「eCup HK Limited」。
如無特別註明,所有字眼關於「禮物卡」代表 咖啡禮物卡(實體版及電子版) 及 「請朋友」咖啡劵。
使用禮物卡條款:
- 禮物卡不可交換或轉讓。
- 當禮物卡購買後,將無法退款。
- 禮物卡餘額必須於指定日期內使用,逾期作廢。
- 禮物卡的所有餘額將不會作現金找贖、現金發還予持卡人或享有利息。
- 顧客可於eCup App查詢禮物卡結餘及使用期限。
- 當禮物卡給顧客接納了,就不能轉讓給其他顧客使用。
- 顧客可以用禮物卡,在eCup App繳付指定合作咖啡店的全部或部份金額。
- 如無特別註明,禮物卡餘額使用期限(有效日期)為禮物卡購買日起計 180 日,明確日期可於eCup App 查詢。
- 禮物卡面額不可交換或轉讓給其他eCup App帳戶。
- 禮物卡不適用於eCup App內市集網購。
- 為保障禮物卡結餘在任何遺失或受損情況下得以追查,eCup非常建議顧客將其eCup App帳戶與電子郵件地址綁定,為日後方便調查及轉變手提電話。
- 對於因未綁定電子郵件地址的顧客而造成的任何損失,eCup將不承擔任何責任。
- eCup不會負責任何未經授權的交易。
- 如顧客因遺失eCup帳戶而造成的任何損失,eCup不會負責任何已完成的交易及已付的費用。
- 倘若eCup相信一些文書、帳單、或會計上發生錯誤時,eCup保留一切更正eCup App的帳戶結餘的權利。如顧客對其交易記錄或更正有任何疑問、或對透過eCup App所進行的任何交易或更正有任何質疑,請電郵到 support@ecup.hk聯絡eCup,我們會進行調查及通知有關結果,及在確定錯誤後盡快提出修正。除非顧客在交易日期的六十天內提出查詢,否則eCup毋須對任何帳單錯誤負責。顧客請仔細監察交易及帳戶結餘。
使用「請朋友」禮物劵附加條款:
- 當顧客購買了「請朋友」禮物劵,可以在七日內傳送給其他顧客使用。
- 當禮物卡給顧客接納了,就不能轉讓給其他顧客使用。
- 若沒有任何顧客於七日內接受該「請朋友」禮物劵,該面額將會自動返還給購買者並不能再次傳送。
不正當使用禮物卡服務條款:
如eCup合理相信或懷疑該eCup禮物卡是未經授權,欺詐或非法使用時,eCup保留不接納禮物卡使用的權利。
協議的修改:
當使用eCup禮物卡時,即表示顧客同意本協議的條款。
eCup有權在任何時間及沒有通知的情況下對本協議內容作出修改,包括有關顧客或eCup權利或責任。
在有關法律容許的情況下,任何本協議的修改、增加或刪改,將在eCup透過其網站或其他方式公佈後即時生效。除非eCup另行公佈,所有修改、增加或刪改適用於顧客將來及現有的eCup App顧客。
終止協議:
eCup 可在沒有通知或法律責任之下,暫時取消或終止本協議,及撤銷或限制任何給予顧客的權利或優惠。本協議會因顧客有欺詐性或在未被受權的情況下使用eCup禮物卡而終止。若eCup在沒有原因的情況下終止本協議,eCup將會退回eCup禮物卡戶口餘額予持卡人。
彌償:
顧客同意如因eCup禮物卡而令eCup蒙受、承受或產生(視乎情形而定)的一切訴訟、法律程序、債務、申索、損失、損害及合理費用及支出,須向eCup作出彌償,除非是因eCup明顯犯錯所致,則作別論。
免責聲明及法律責任的限制:
eCup並未為eCup禮物卡出任何申述、保証或任何明示或暗示的條件,包括但不限制於對適銷性、針對特定用途的適用性,所有權以及不侵權,或任何於貿易上、交易或履行協議時所產生的保證。eCup不會申述或擔保顧客的eCup禮物卡能一直被使用或被接受。
在eCup對顧客負責任的情況下,顧客只有權取回實際及直接的賠償,而該賠償不能超過顧客eCup禮物卡上的最後餘額。eCup不會對任何因本協議而產生或與本協議有關,包括因合同法、保証法、侵權法(包括疏忽、不論是主動、被動或認定而知道)、產品的法律責任、嚴格法律責任或其他的理論所附帶、間接或相應而生的損失(包括但不限於盈利、收入或使用上的虧損)負責,縱然該損失是起源於或以任何方式與本協議有關。
在任何情況下,eCup不會對於未被受權的使用或更改、被竊取或損毀的eCup禮物卡負上任何法律責任,不論是因為意外、誤用、或因持卡人或任何第三者以欺詐性手法或裝置,或因為任何不eCup的控制範圍之內的情況而發生的延遲或錯誤。
如有任何爭論,eCup HK Limited 保留最終決定權。

TERMS & CONDITIONS - COFFEE GIFT CARD (PHYSICAL AND DIGITAL) AND “FRIEND TREAT” E-GIFT SERVICE
By using this service, the Customer agrees to the terms of this Agreement.
This service applies to beverages and snacks served by all eCup partnered coffee shops ordered through the eCup App. The customer needs to pick-up the order in-person at the cafe.
“eCup” means “eCup HK LIMITED”.
If not specified, “Gift Card” means “Coffee Gift Card(Physical and Digital)” and “Friend Treat e-Gift”.
GIFT CARD SERVICES USER TERMS AND CONDITIONS :
- The Gift Card cannot be exchanged or transferred.
- The Gift Card is not refundable once it has been purchased.
- The Gift Card balance must be redeemed before the corresponding expiry date.
- No change or cash refund will be provided, and no interest will be credited for any unused balance in the Gift Card.
- Customers can inquire about Gift Card balance and expiry date in the eCup App.
- Once the Gift Card has been redeemed by the customer, it cannot be transferred to other eCup accounts.
- The Gift Card can be presented in full or partial payment for goods purchased at eCup partnered coffee shops.
- If not specified, Gift Card balance expires after 180 days of the date purchased, customers can inquire about the specific date in the eCup App.
- Gift Card value cannot be exchanged or transferred to other eCup Accounts.
- The Gift Card does not apply to online shopping within eCup App Marketplace.
- To protect customers against loss of Gift Card balance, eCup highly recommends customers to bind their eCup App account with relating email address, to assist future investigation and retrieve the remaining balance accordingly.
- eCup is not liable for any loss due to an unbound email customer.
- eCup is not responsible for any unauthorized transaction associated with the Gift Card.
- eCup is not responsible for any transaction effect and charge incurred with the loss of the eCup Account.
- eCup reserves the right to correct the balance of the Gift Card services if eCup believes that a clerical, billing, or accounting error has occurred. If the customer has any questions regarding transaction history or any such correction, or if the customer disputes any transaction or correction that has been assessed against the credit balance, please email support@ecup.hk. eCup will investigate and communicate the results and correct any error that eCup verifies as soon as eCup finishes the investigation. eCup shall have no liability for any billing error unless the customer provides eCup notice within sixty (60) days of the date of the transaction in question. The Gift Card holder should monitor the transactions and account balances closely.
ADDITIONAL USER TERMS AND CONDITIONS FOR “FRIEND TREAT” E-GIFT SERVICES :
- Once the “Friend Treat” e-Gift has been purchased, the customer can resend it to any eCup App users within 7 days.
- Once the “Friend Treat” e-Gift has been redeemed, it cannot be transferred to other eCup accounts.
- If the “Friend Treat” e-Gift hasn't been accepted by any eCup App users within 7 days, the e-Gift balance will return to the buyer automatically and can no longer be sent to others again.
MISUSE OR FRAUD CASE TERMS AND CONDITIONS FOR GIFT CARD SERVICES :
eCup reserves the right not to accept any Gift Card if eCup reasonably believes that the use is unauthorized, fraudulent, or otherwise unlawful.
CHANGES TO TERMS AND CONDITIONS :
Use of the Gift Card service constitutes the customer’s acknowledgment of and the agreement to abide by the terms and conditions outlined in this Agreement.
eCup reserves the right to amend the terms and conditions at its discretion, including any rights or obligations the customer or eCup may have without prior notice.
As permitted by applicable law, any change, addition, or deletion will become effective at the time eCup posts the revised agreement to its website or other means. Unless eCup states otherwise, the change, addition, or deletion will apply to current and new customers.
TERMINATION :
eCup may suspend or terminate this Agreement or revoke or limit any or all the rights and privileges granted to the customer at any time without notice or legal liability. Termination may result from the customer’s fraudulent or unauthorized use of the Card. If eCup terminates this Agreement without cause, eCup will refund the balance held in the eCup account.
INDEMNITY :
The Customer agrees to indemnify eCup against all actions, proceedings, liabilities, claims, loss, damages, and reasonable costs and expenses which may be taken against eCup or which eCup may suffer, sustain or incur (as the case be) in respect of the customer unless the same were caused by any manifest error on eCup’s part.
DISCLAIMERS AND LIMITS OF LIABILITY :
eCup and its affiliates make no representations, warranties, or conditions of any kind, express or implied, with respect to the Gift Card services, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement, or any warranty arising by usage of trade, course of dealing or course of performance. eCup does not represent or warrant that Gift Card Services will always be accessible or accepted.
In the event that eCup or its affiliates are found liable, the customer shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on the eCup app. eCup and its affiliates shall have no liability for any incidental, indirect, or consequential damages (including without limitation loss of profit, revenue, or use) arising out of or in any way connected with this Agreement, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, even if eCup or its authorized representatives have been advised of the possibility of such damages.
In no event shall eCup or its affiliates have any liability for unauthorized access to, or alteration, theft, or destruction of the Gift card through accident, misuse, or fraudulent means or devices by the customer or any third party, or as a result of any delay or mistake resulting from any circumstances beyond eCup control.
Should there be any dispute, eCup reserves the right of final decision.
The Chinese translation is provided for reference only. In case of any discrepancy between the English and Chinese versions, the former shall prevail.
