條款及細則 - 充值及禮品卡

通過使用此服務,咖啡廳提供商及其每個客戶均同意本協議的條款。

  • 此服務僅可用於在香港提供充值和禮品卡服務平台的中兌換商品/食品/飲料並累積獎勵。禮品卡和充值服務適用於香港的eCup指定合作夥伴咖啡店。為避免任何疑問或困惑,此充值和禮品卡服務平台的使用和管理應嚴格遵守《支付系統及儲值支付工具條例》第584章 中的單一目的儲值支付工具的定義。香港法律)和任何相關法律和法規。


eCup Mobile App 顧客的帳戶:

  • 顧客可以通過這個服務為他們的增值eCup帳戶。
  • 客戶全權負責為該服務充值。
  • 增值的價值,只可以在指定eCup合作咖啡店兌換貨物/食物/飲品,從中也可以獲取有關的電子印花。
  • eCup指定合作夥伴咖啡店同意在充值和禮品卡服務的使用和管理中嚴格遵守與收集和存儲用戶數據,私人信息或個人數據(如果有)有關的所有法律和法規。平台。
  • 如ECUP合理相信或懷疑eCup Top Up/ Gift Card是未經授權,欺詐或非法使用時,ECUP保留不接納eCup Top Up/ Gift Card使用的權利。
  • 除非法律要求下,eCup Top Up/ Gift Card的所有餘額將不會作現金找贖、現金發還予持卡人或享有利息。
  • eCup Top Up/ Gift Card不可交換或轉讓。
  • 當Gift Card給顧客接納了,就不能給其他顧客使用。
  • 每次eCup Top Up增值只可最多儲值港幣1,000元。ECUP可隨時更改最高及最低的儲值額,並透過eCup合作咖啡店或ECUP Mobile App通知ECUP Mobile App顧客。
  • 顧客可於指定eCup合作咖啡惠顧任何產品,並以eCup Top Up/ Gift Card Credit繳付全數或部份金額。
  • 顧客可於eCup Mobile App結餘/使用期限。
  • 當禮品卡購買後將無法退款。
  • 如有遺失eCup Account,ECUP不會負責任何已完成的交易及已產生的費用。
  • ECUP不會負責任何未經授權的交易。
  • 為保障eCup Top Up/ Gift Card在任何遺失或受損情況下的結餘,ECUP將建議顧客將其eCup Mobile App帳戶與電子郵件地址綁定,為日後方便調查及轉變手提電話。
  • 對於因未綁定電子郵件地址顧客而造成的任何損失,ECUP將不承擔任何責任。
  • ECUP只會在eCup Mobile App帳戶與電子郵件地址綁定後才受到保障。
  • eCup Top Up/ Gift Card價值不可以轉讓給其他eCup Mobile App帳戶。
  • 倘若ECUP相信一些文書、帳單、或會計上發生錯誤時,ECUP保留一切更正eCup Mobile App的帳戶結餘的權利。如顧客對其交易記錄或更正有任何疑問、或對透過eCup Mobile App所進行的任何交易或更正有任何質疑,請電郵件到info@ecup.hk聯絡ECUP會進行調查及通知持卡人有關結果,及在確定錯誤後盡快提出修正。如在調查沒有發現任何錯誤,ECUP亦會通知顧客有關結果。除非顧客在交易日期的六十天內提出查詢,否則ECUP毋須對任何帳單錯誤負責。顧客請仔細監察交易及帳戶結餘。
    協議的修改:
  • 當使用eCup Top Up/ Gift Card時,即表示顧客同意本協議的條款。
  • ECUP有權在任何時間及沒有通知的情況下對本協議內容作出修改,包括有關顧客或ECUP權利或責任。
  • 在有關法律容許的情況下,任何本協議的修改、增加或刪改,將在ECUP透過其網站、分店或其他方式公佈後即時生效。除非ECUP另行公佈,所有修改、增加或刪改適用於顧客將來及現有的eCup Mobile App顧客。
    終止協議:
  • ECUP可在沒有通知或法律責任之下,暫時取消或終止本協議,及撤銷或限制任何給予顧客的權利或優惠。本協議會因顧客有欺詐性或在未被受權的情況下使用eCup Top Up/ Gift Card而終止。若ECUP在沒有原因的情況下終止本協議,ECUP將會退回eCup Top Up/ Gift Card戶口餘額予持卡人。
    彌償:
  • 顧客同意如因eCup Top Up/ Gift Card而令ECUP蒙受、承受或產生(視乎情形而定)的一切訴訟、法律程序、債務、申索、損失、損害及合理費用及支出,須向ECUP作出彌償,除非是因ECUP明顯犯錯所致,則作別論。
    免責聲明及法律責任的限制:
  • ECUP並未為eCup Top Up/ Gift Card作出任何申述、保証或任何明示或暗示的條件,包括但不限制於對適銷性、針對特定用途的適用性,所有權以及不侵權,或任何於貿易上、交易或履行協議時所產生的保證。ECUP不會申述或擔保顧客的eCup Top Up/ Gift Card能一直被使用或被接受。
  • 在ECUP對顧客負責任的情況下,顧客只有權取回實際及直接的賠償,而該賠償不能超過顧客eCup  Top Up/ Gift Card上的最後餘額。ECUP不會對任何因本協議而產生或與本協議有關,包括因合同法、保証法、侵權法(包括疏忽、不論是主動、被動或認定而知道)、產品的法律責任、嚴格法律責任或其他的理論所附帶、間接或相應而生的損失(包括但不限於盈利、收入或使用上的虧損)負責,縱然該損失是起源於或以任何方式與本協議有關。
  • 在任何情況下,ECUP不會對於未被受權的使用或更改、被竊取或損毀的eCup Top Up/ Gift Card負上任何法律責任,不論是因為意外、誤用、或因持卡人或任何第三者以欺詐性手法或裝置,或因為任何不ECUP的控制範圍之內的情況而發生的延遲或錯誤。
  • 如有任何爭論,eCup HK Limited 保留最終決定權。

TERMS & CONDITIONS OF THE TOP UP/ GIFT CARD SERVICE

By using this Service, the Cafe Provider and each of its Customer agrees to the terms of this Agreement.

  1. The customer takes the sole responsibility to top up his/ her credit for this service.
  2. This service can only be used in exchange for goods/ foods/ drinks and to accumulate rewards in any of the shops that provided such top up and gift card service platform  in Hong Kong. The gift card and top up service shall not be applicable to other eCup partner coffee shops in Hong Kong. To avoid any doubt or confusion, the use and administration of this top up and gift card services platform shall conform, in the strictest compliance, to the definitions of a single purpose stored value facility under the Payment Systems and Stored Value Facilities Ordinance (Chapter 584 of the laws of Hong Kong) and any relevant laws and regulations.
  3. The Cafe Provider agrees to abide by, in strict compliance, with all laws and regulations in relation to the collection and storage of user data, private information, or personal data  if any, in the use and administration of the top up and gift card services platform. 
  4. ECUP reserves the right not to accept any Top Up / Gift Card Credit if ECUP reasonably believes that the use is unauthorized, fraudulent or otherwise unlawful.
  5. Unless otherwise required by law, no change or cash refund will be provided and no interest will be credited to the Customer by ECUP.
  6. The Top Up Credit/ Gift Card cannot be exchanged or transferred.
  7. Once the Gift Card has been accepted by any customer, which won’t be able to use it anymore.
  8. The maximum Top Up Credit for each transaction is HK $1000. ECUP may change the maximum and minimum amounts at any time by notifying the customer at the eCup partnered Coffee Shops or on eCup Mobile App.
  9. The eCup Top Up/ Gift Card credit can be presented in full or partial payment for goods purchased at specific eCup partnered coffee shop..
  10. Customer can enquiry the Top Up Credit/ Gift Card Balance and expiry date in the eCup mobile application. 
  11. There’s no refund once the gift card has been purchased.
  12. ECUP is not responsible for any transaction effect and charge incurred with the loss of the eCup Account.
  13. ECUP is not responsible for any unauthorized transaction associated with the Top Up/ Gift Card credit.
  14. To protect customer against loss of the credit, ECUP will recommend customer to bind their eCup Mobile App account with relate email address which customer can retrieve their credit accordingly.
  15. ECUP will not be liable for any lost due to unbinded email customer.
  16. The credit balance is only protected starting from the point in time the customer has binded their email with the eCup mobile App account.
  17. ECUP Top Up/ Gift Card Service won’t support transfer credit to other eCup Account.
  18. ECUP reserves the right to correct the balance of the Top Up Credit/ Gift Card Services if ECUP believes that a clerical, billing or accounting error has occurred. If the customer have any questions regarding transaction history or any such correction, or if the customer disputes any transaction or correction that has been assessed against the credit balance, please email to info@ecup.hk. ECUP will conduct an investigation and communicate the results and correct any error that ECUP verifies as soon as ECUP finishes the investigation.  If no error is found, ECUP will provide an explanation. ECUP shall have no liability for any billing error unless the customer provides ECUP notice within sixty (60) days of the date of the transaction in question. The Card Holder should monitor the transactions and account balances closely.
  19. Use of the Top Up / Gift Card Service constitutes the customer’s acknowledgement of and the agreement to abide by the terms and conditions set forth in this Agreement.ECUP reserves the right to amend the terms and conditions at its discretion, including any rights or obligations the customer or ECUP may have without prior notice. As permitted by applicable law, any change, addition or deletion will become effective at the time ECUP posts the revised agreement to its website. Unless ECUP states otherwise, the change, addition or deletion will apply to the customer’s further.
  20. Termination – ECUP  may suspend or terminate this Agreement or revoke or limit any or all of the rights and privileges granted to the customer at any time without notice or liability. Termination may result from the customer’s fraudulent or unauthorized use of the Card. If ECUP terminates this Agreement without cause, ECUP will refund the balance held in the eCup account less any amounts that the customer may owe to ECUP.
  21. Indemnity – The Customer agrees to indemnify ECUP against all actions, proceedings, liabilities, claims, loss, damages and reasonable costs and expenses which may be taken against ECUP or which ECUP may suffer, sustain or incur (as the case be) in respect of the customer unless the same were caused by any manifest error on ECUP’s part.
  22. Disclaimers and Limits of Liability – ECUP and its affiliates make no representations, warranties or conditions of any kind, express or implied, with respect to the Top Up/ Gift Card services, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement, or any warranty arising by usage of trade, course of dealing or course of performance. ECUP does not represent or warrant that the Top Up/ Gift Card Services will always be accessible or accepted. In the event that ECUP or its affiliates are found liable to the ECUP, the customer shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on the mobile app. ECUP and its affiliates shall have no liability for any incidental, indirect or consequential damages (including without limitation loss of profit, revenue or use) arising out of or in any way connected with this Agreement, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, even if ECUP or its authorized representatives have been advised of the possibility of such damages. In no event shall ECUP or its affiliates have any liability for unauthorized access to, or alteration, theft or destruction of the Top Up/ Gift Card services through accident, misuse, or fraudulent means or devices by the customer or any third party, or as a result of any delay or mistake resulting from any circumstances beyond ECUP’s control.
  23. Should there be any dispute, ECUP reserves the right of final decision.
  24. English Version Prevail – The Chinese translation is provided for reference only. In case of any discrepancy between the English and Chinese versions, the former shall prevail.
